Terms & Conditions - Landscaping
Arthur & Simon Ltd.
• The client will be responsible for all payments to Arthur & Simon Ltd. unless otherwise notified in writing prior to commencement.
• The client shall provide water and electricity at no charge to Arthur & Simon Ltd.
• The client shall provide access to site during Arthur & Simon Ltd. normal working hours and storage space for materials during the contract progress.
• Any addition and/or alterations to the schedule shall be properly treated as variations and subject to written instructions.
• Arthur & Simon Ltd. is not able to accept responsibility for any damage to (or cost involved with) any underground hazards, obstructions or services not made known to us in writing or apparent on visual inspection.
• Stage payments of against works completed/materials on site to be made at weekly intervals. Final payment to be made following completion and payable within 7 days of our invoice.
• Price to remain fixed until the end of 6 weeks. Acceptance before that date will ensure no increase in the cost of the works specified in the quotation.
• All or any special conditions, of which Arthur & Simon Ltd. has been informed are noted in the quotation.
• It is very important and the responsibility of the Client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.
• We accept no responsibility for works that have been carried out on land that is not under the ownership of the client and it is assumed that all planning laws or regulations have been applied before commencement of any works.
• We are not able to accept responsibility for the well being and maintenance of living plant material, including turf, following practical substantial completion unless a maintenance contract is in existence.
• If necessary we reserve the right to substitute any plant with another of equal value and growth/habitat/colour in accordance with the specification.
• After practical substantial completion, we are not able to accept responsibility for any damage through the elements, including drought, winds, rain and frost to any material(s) including plants.
• Upon practical substantial completion the responsibility for the care and watering of all plants, lawns, etc., is handed over to the client and will require regular attention until established.
• Severe weather conditions, including drought, may cause the delay of the start date of the contract.
• Delays caused by other companies on site may cause work to be rescheduled and charges may be made in certain circumstance
• All materials on site remain the property of Arthur & Simon Ltd. until payment is received in full.
• Maintenance is not included in the contract unless specified.
• We reserve the right to change these terms and conditions at any time.
Terms & Conditions - Garden Maintenance
Arthur & Simon Ltd.
• Price to remain fixed for four weeks from the date of quotation. Acceptance before that date will ensure no increase in the cost of the works specified in the quotation.
• Payments to Arthur & Simon Ltd will be made in monthly installments (unless agreed otherwise).
• The number of visit per year stated in the estimate may change slightly due to unforeseen weather conditions or the individual requirements of your garden at the time.
• The term waste removal refers only to waste produced by Arthur & Simon Ltd, it excludes disposal of any material otherwise on site.
• Due to Health & Safety regulations it is the responsibility of the client to keep the site clean of dog excrement. Arthur & Simon Ltd reserve the right to charge for the visit in full (unless agreed otherwise) if the site is not safe to work on the date of a scheduled visit.
• If access to the site is prevented on the date of a scheduled visit or if less than 5 days notice is given Arthur & Simon Ltd reserves the right to charge for the visit in full.
• All or any special conditions, of which Arthur & Simon Ltd have been informed, are noted in the quotation.
• It is very important and the responsibility of the Client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.
• Arthur & Simon Ltd agree to be held responsible for Arthur & Simon Ltd staff and/or sub-contractors whilst on-site.
• Arthur & Simon Ltd undertake to provide staff who are adequately trained or experienced and competent staff for the undertaking of all or part of the project and only carry out the work as specified - all staff shall remain adequately supervised at all times.
• Arthur & Simon Ltd undertake to insure our activities against all risks whilst engaged on your site - a copy of our third party public and employer’s liability insurance document can delivered on request.
• Arthur & Simon Ltd agree to an external vetting procedure should you be unhappy with any aspects of the project. In the unlikely event of their being a complaint, we agree for the mutual appointment of a professional for the purposes of vetting and scrutinising our workmanship.
• Should the findings of this third party consider that we are at fault, we will agree to rectify to an acceptable standard - Should a suitable way forward not be found under this method, both parties shall be obliged to continue settlement under British law.
• This is a one year rolling contract and both parties will be required to give one month notice to end it or make changes to the contract.
• We reserve the right to change these terms and conditions at any time.
